STATUTORY GUIDELINES 2024

Student Rights Under MoE Coaching Centre Regulations (2024)

The Ministry of Education, Government of India, issued comprehensive national guidelines for the regulation of private coaching centres. Here are the key statutory consumer rights every student and parent is entitled to.

1Mandatory Registration & Minimum Age

  • Threshold: Any coaching centre training students must be formally registered with the local competent authority.
  • Age Limit: Coaching centres are prohibited from enrolling students below 16 years of age or prior to completing secondary school (Class 10).
  • Tutor Qualification: Centres cannot engage tutors who possess qualifications less than graduation.

210-Day Pro-Rata Fee Refund Rule (Non-Negotiable)

Under Section 7 of the Guidelines, if a student leaves a course prematurely after having paid the full fee upfront:

• The centre MUST refund the remaining fee on a pro-rata basis within 10 days of application.

• This includes hostel fees, mess charges, and examination materials pro-rated for the unexpired duration.

• Any clause in the enrolment contract stating "fees once paid will not be refunded under any circumstances" is void and legally unenforceable.

3Prohibition on Misleading Advertisements

  • No Guaranteed Rank Claims: Centres are strictly barred from publishing misleading advertisements claiming guaranteed admission, ranks, or job offers.
  • Transparent Faculty Profiles: Centres must display authentic tutor credentials and realistic success records on their public notice boards.
  • No Publishing Commissions: Centres cannot force students to purchase designated books or collect referral commissions from third-party publishers.

4Study Hours, Holidays & Mental Health

  • School Hours Respected: Coaching classes cannot run during regular school hours of enrolled students to prevent proxy school attendance.
  • Mandatory Weekly Off: A mandatory weekly off must be provided to students without conducting tests or homework assessments.
  • Counselling Cell: Registered centres must establish a mental health counselling cell and train staff in student mental wellness sensitization.

5Grievance Redressal & Complaints

If a coaching institute violates the guidelines or refuses a valid fee refund:

  1. File a formal written complaint with the District Magistrate / competent authority designated by your State Government.
  2. Lodge an online complaint at the National Consumer Helpline (NCH) portal at consumerhelpline.gov.in or dial 1915.
  3. Submit a grievance on the Central Government PG Portal at pgportal.gov.in.
